病假期内回公司工作,受伤可否认定为工伤?

【案情简介(jie)】

2015年4月(yue),小(xiao)(xiao)(xiao)李(li)通过上海某康复设(she)(she)(she)备有限公(gong)(gong)(gong)司(si)的(de)(de)面试。公(gong)(gong)(gong)司(si)初步安排其在(zai)精(jing)工(gong)车间做车工(gong),双(shuang)方签订了(le)《新录(lu)用(yong)员工(gong)试用(yong)表》和《安全责任协议(yi)书》,试用(yong)期(qi)3个月(yue),约定(ding)期(qi)满后(hou)(hou)符合(he)录(lu)用(yong)条件的(de)(de)正式签订劳(lao)动合(he)同。2015年5月(yue)12日,小(xiao)(xiao)(xiao)李(li)因病(bing)向公(gong)(gong)(gong)司(si)请(qing)假3天,并提(ti)(ti)交(jiao)了(le)医院(yuan)的(de)(de)病(bing)假条。但休(xiu)息2天后(hou)(hou),小(xiao)(xiao)(xiao)李(li)自觉身体康复,便回到公(gong)(gong)(gong)司(si)上班,并被(bei)(bei)车间主任指(zhi)派从(cong)事新工(gong)作----切(qie)割塑钢(gang)板。在(zai)切(qie)割过程中(zhong),小(xiao)(xiao)(xiao)李(li)左(zuo)手不(bu)慎(shen)被(bei)(bei)锯片锯伤(shang),经医院(yuan)诊断(duan)为(wei)(wei)左(zuo)手食指(zhi)粉碎性骨折、神经断(duan)裂(lie)。小(xiao)(xiao)(xiao)李(li)随后(hou)(hou)填报(bao)了(le)《工(gong)伤(shang)认(ren)定(ding)申请(qing)表》申请(qing)工(gong)伤(shang)认(ren)定(ding),康复设(she)(she)(she)备公(gong)(gong)(gong)司(si)所在(zai)区(qu)劳(lao)动和社会(hui)保障局认(ren)定(ding)小(xiao)(xiao)(xiao)李(li)所受伤(shang)为(wei)(wei)工(gong)伤(shang)。康复设(she)(she)(she)备公(gong)(gong)(gong)司(si)不(bu)服工(gong)伤(shang)认(ren)定(ding)结论,申请(qing)行(xing)政复议(yi),得到维持工(gong)伤(shang)认(ren)定(ding)通知书后(hou)(hou),向法(fa)院(yuan)提(ti)(ti)起了(le)行(xing)政诉讼。

【争议焦(jiao)点&审理结果】

本案(an)的(de)争议焦点:小李在病假期间自(zi)行回(hui)公司上班受伤,是否属于(yu)工(gong)伤?

该公司认为,小李仍(reng)处试用(yong)期,并非(fei)公司正(zheng)式员工,且(qie)其受(shou)伤(shang)是在(zai)休病假期间(jian)内而非(fei)工作(zuo)时间(jian),切割塑钢板亦非(fei)其工作(zuo)岗位,故其受(shou)伤(shang)并非(fei)因工作(zuo)原因,请求法院撤销工伤(shang)认定结论。

法院认(ren)为(wei)(wei),根(gen)据国务院《工(gong)(gong)(gong)伤(shang)(shang)(shang)保(bao)(bao)险条(tiao)(tiao)(tiao)例(li)》第(di)14条(tiao)(tiao)(tiao)第(di)(1)项的(de)规定(ding),在工(gong)(gong)(gong)作(zuo)(zuo)时间(jian)和工(gong)(gong)(gong)作(zuo)(zuo)场所内,因工(gong)(gong)(gong)作(zuo)(zuo)原因受(shou)到事故伤(shang)(shang)(shang)害的(de),应当认(ren)定(ding)为(wei)(wei)工(gong)(gong)(gong)伤(shang)(shang)(shang)。小(xiao)李(li)与(yu)康复设备公司建(jian)立了劳动关系,其受(shou)伤(shang)(shang)(shang)符合认(ren)定(ding)工(gong)(gong)(gong)伤(shang)(shang)(shang)应具备的(de)工(gong)(gong)(gong)作(zuo)(zuo)时间(jian)、工(gong)(gong)(gong)作(zuo)(zuo)地点(dian)、工(gong)(gong)(gong)作(zuo)(zuo)原因受(shou)伤(shang)(shang)(shang)的(de)条(tiao)(tiao)(tiao)件(jian),区劳动保(bao)(bao)障局作(zuo)(zuo)出工(gong)(gong)(gong)伤(shang)(shang)(shang)的(de)结论正确,应予(yu)维持(chi)。

法院最终(zhong)维持了区劳动保(bao)障局(ju)作(zuo)出的工伤认定决定。

【案(an)件评析】

首(shou)先,根据(ju)《劳动(dong)(dong)(dong)合(he)同(tong)法》第7条规定,用(yong)人单位自用(yong)工(gong)之(zhi)日起即与劳动(dong)(dong)(dong)者建立(li)劳动(dong)(dong)(dong)关(guan)系(xi)。因(yin)此(ci)劳动(dong)(dong)(dong)关(guan)系(xi)成立(li)的(de)(de)标(biao)志(zhi),不是(shi)依(yi)据(ju)书面劳动(dong)(dong)(dong)关(guan)系(xi)合(he)同(tong)的(de)(de)签(qian)订与否(fou),而(er)是(shi)根据(ju)用(yong)工(gong)之(zhi)日这(zhei)个事实(shi)。在本案中,虽然小(xiao)李(li)并未与康(kang)复(fu)设备公(gong)(gong)司(si)签(qian)订正(zheng)式(shi)的(de)(de)用(yong)工(gong)合(he)同(tong),但实(shi)际上其已(yi)经是(shi)公(gong)(gong)司(si)成员,为该公(gong)(gong)司(si)提供了劳动(dong)(dong)(dong)。因(yin)此(ci),小(xiao)李(li)虽处于试用(yong)期内,但其与康(kang)复(fu)设备公(gong)(gong)司(si)的(de)(de)劳动(dong)(dong)(dong)关(guan)系(xi)已(yi)经成立(li),能够作为被认(ren)定为工(gong)伤(shang)的(de)(de)主体(ti)。

其(qi)(qi)次,关于是否符(fu)(fu)合(he)工(gong)(gong)(gong)(gong)(gong)伤(shang)(shang)认定三要(yao)(yao)素标(biao)准的(de)(de)问(wen)题。根据《工(gong)(gong)(gong)(gong)(gong)伤(shang)(shang)保险条例(li)》第14条第(1)项的(de)(de)规定,在(zai)工(gong)(gong)(gong)(gong)(gong)作时(shi)(shi)间(jian)(jian)(jian)和(he)工(gong)(gong)(gong)(gong)(gong)作场所内,因(yin)(yin)(yin)工(gong)(gong)(gong)(gong)(gong)作原因(yin)(yin)(yin)受(shou)到事(shi)(shi)故伤(shang)(shang)害(hai)的(de)(de),应(ying)当认定为工(gong)(gong)(gong)(gong)(gong)伤(shang)(shang)。在(zai)本(ben)案中,小李(li)(li)虽然尚(shang)处休(xiu)病假(jia)期(qi)间(jian)(jian)(jian),但其(qi)(qi)在(zai)病假(jia)最后一天(tian)放(fang)弃休(xiu)假(jia),主(zhu)动回(hui)公(gong)(gong)司工(gong)(gong)(gong)(gong)(gong)作,且公(gong)(gong)司对(dui)(dui)其(qi)(qi)工(gong)(gong)(gong)(gong)(gong)作有所安排,使(shi)小李(li)(li)在(zai)公(gong)(gong)司正常的(de)(de)工(gong)(gong)(gong)(gong)(gong)作时(shi)(shi)间(jian)(jian)(jian)和(he)场所内从事(shi)(shi)有偿劳动,应(ying)当视为公(gong)(gong)司对(dui)(dui)小李(li)(li)放(fang)弃休(xiu)假(jia)进行(xing)(xing)正常工(gong)(gong)(gong)(gong)(gong)作的(de)(de)认同,符(fu)(fu)合(he)在(zai)“在(zai)工(gong)(gong)(gong)(gong)(gong)作时(shi)(shi)间(jian)(jian)(jian)和(he)工(gong)(gong)(gong)(gong)(gong)作场所内”的(de)(de)要(yao)(yao)求。另外,虽然小李(li)(li)从事(shi)(shi)的(de)(de)工(gong)(gong)(gong)(gong)(gong)作不是最初(chu)使(shi)用时(shi)(shi)指派的(de)(de)工(gong)(gong)(gong)(gong)(gong)作,而是车间(jian)(jian)(jian)主(zhu)任指派的(de)(de)新工(gong)(gong)(gong)(gong)(gong)作,但同样(yang)也是因(yin)(yin)(yin)工(gong)(gong)(gong)(gong)(gong)作原因(yin)(yin)(yin)受(shou)到伤(shang)(shang)害(hai),其(qi)(qi)工(gong)(gong)(gong)(gong)(gong)作岗位的(de)(de)不同并不会影响工(gong)(gong)(gong)(gong)(gong)作原因(yin)(yin)(yin)受(shou)伤(shang)(shang)的(de)(de)认定。因(yin)(yin)(yin)此,小李(li)(li)在(zai)病假(jia)期(qi)间(jian)(jian)(jian)自行(xing)(xing)回(hui)公(gong)(gong)司上(shang)班受(shou)伤(shang)(shang)符(fu)(fu)合(he)工(gong)(gong)(gong)(gong)(gong)伤(shang)(shang)认定三要(yao)(yao)素标(biao)准。

综上,小李(li)所受伤应(ying)为工伤。
