下班后留办公室能否算加班?

【案情简介】

王(wang)某(mou)大学毕业后(hou)就(jiu)职(zhi)于一家广(guang)告公(gong)(gong)司(si)(si),与该(gai)公(gong)(gong)司(si)(si)签(qian)订三年(nian)(nian)期劳动(dong)合(he)同,从事(shi)市场推广(guang)工(gong)(gong)作(zuo)。王(wang)某(mou)工(gong)(gong)作(zuo)十分卖力,下班(ban)(ban)后(hou)同事(shi)们纷纷离开公(gong)(gong)司(si)(si),而(er)王(wang)某(mou)经常(chang)留在(zai)办公(gong)(gong)室(shi)继续做(zuo)事(shi)。工(gong)(gong)作(zuo)满两年(nian)(nian)后(hou),王(wang)某(mou)为了谋求(qiu)更好的(de)(de)发展向(xiang)公(gong)(gong)司(si)(si)提出辞职(zhi)。同时,要(yao)(yao)求(qiu)公(gong)(gong)司(si)(si)支(zhi)付其(qi)两年(nian)(nian)来(lai)的(de)(de)加班(ban)(ban)工(gong)(gong)资(zi)。公(gong)(gong)司(si)(si)感到非常(chang)不解,公(gong)(gong)司(si)(si)从未(wei)要(yao)(yao)求(qiu)王(wang)某(mou)加班(ban)(ban),而(er)是王(wang)某(mou)经常(chang)下班(ban)(ban)后(hou)主动(dong)留在(zai)办公(gong)(gong)室(shi)不回家。两年(nian)(nian)来(lai)王(wang)某(mou)也从未(wei)向(xiang)公(gong)(gong)司(si)(si)提出加班(ban)(ban)工(gong)(gong)资(zi),故(gu)公(gong)(gong)司(si)(si)无须支(zhi)付其(qi)加班(ban)(ban)工(gong)(gong)资(zi)。得知公(gong)(gong)司(si)(si)不愿支(zhi)付加班(ban)(ban)工(gong)(gong)资(zi)后(hou),王(wang)某(mou)向(xiang)某(mou)区劳动(dong)人事(shi)争议仲裁(cai)委(wei)员会申请(qing)仲裁(cai),要(yao)(yao)求(qiu)公(gong)(gong)司(si)(si)支(zhi)付其(qi)两年(nian)(nian)来(lai)的(de)(de)加班(ban)(ban)工(gong)(gong)资(zi)。

【争(zheng)议焦点&裁决(jue)结果】

本案(an)的争义焦点:下(xia)班后留在办公室算(suan)加(jia)班吗?

王某认(ren)为:他每天下班后(hou)继续(xu)留在办公室工作,理应(ying)属于加(jia)班。而(er)且(qie)他有(you)考勤记录证明(ming)(ming)其(qi)每天在公司(si)的时间(jian),明(ming)(ming)显超过8小(xiao)时。所以,公司(si)应(ying)当根据(ju)其(qi)加(jia)班时间(jian)支(zhi)付(fu)其(qi)加(jia)班工资。

公(gong)司认为(wei):公(gong)司并未安排王某超时工(gong)作,是王某自(zi)愿每天下(xia)班(ban)后(hou)不离(li)开公(gong)司。况且(qie)公(gong)司有明确的(de)加班(ban)审批(pi)制度(du)。任何员工(gong)加班(ban)都需要(yao)提出申(shen)请,经上级领导批(pi)准后(hou)才属于(yu)加班(ban)。因此,王某的(de)情(qing)况不属于(yu)加班(ban),公(gong)司无须支(zhi)付其加班(ban)工(gong)资(zi)。

仲裁委员(yuan)会审(shen)理(li)后认(ren)为:王(wang)某虽提(ti)供考勤记录证(zheng)(zheng)明其(qi)每天在公司(si)(si)时(shi)间超(chao)过8小时(shi),但并(bing)未提(ti)供证(zheng)(zheng)据(ju)证(zheng)(zheng)明其(qi)下班(ban)(ban)后留(liu)在公司(si)(si)的(de)时(shi)间是在处(chu)理(li)工作。公司(si)(si)有明确的(de)加(jia)(jia)班(ban)(ban)审(shen)批(pi)制度,王(wang)某并(bing)未按照加(jia)(jia)班(ban)(ban)审(shen)批(pi)制度进行加(jia)(jia)班(ban)(ban)申请而自行留(liu)在公司(si)(si)处(chu)理(li)事务。因(yin)此,认(ren)定王(wang)某的(de)行为不(bu)(bu)属(shu)于(yu)(yu)加(jia)(jia)班(ban)(ban),对于(yu)(yu)王(wang)某要求公司(si)(si)支付其(qi)加(jia)(jia)班(ban)(ban)工资的(de)仲裁请求不(bu)(bu)予(yu)支持。

【案件(jian)评析】

本案的(de)(de)争议焦点是(shi)(shi)王(wang)某(mou)(mou)下(xia)(xia)班(ban)(ban)(ban)(ban)(ban)后(hou)继续留在办公(gong)(gong)室是(shi)(shi)否属(shu)于(yu)加(jia)(jia)(jia)(jia)班(ban)(ban)(ban)(ban)(ban)?加(jia)(jia)(jia)(jia)班(ban)(ban)(ban)(ban)(ban)是(shi)(shi)指劳动(dong)者(zhe)在法(fa)(fa)(fa)定(ding)(ding)工作(zuo)时(shi)(shi)(shi)间(jian)以外的(de)(de)超(chao)时(shi)(shi)(shi)工作(zuo)。我国《劳动(dong)法(fa)(fa)(fa)》规定(ding)(ding)了三类加(jia)(jia)(jia)(jia)班(ban)(ban)(ban)(ban)(ban),工作(zuo)日(ri)延(yan)时(shi)(shi)(shi)加(jia)(jia)(jia)(jia)班(ban)(ban)(ban)(ban)(ban)、双休日(ri)加(jia)(jia)(jia)(jia)班(ban)(ban)(ban)(ban)(ban)、法(fa)(fa)(fa)定(ding)(ding)节假日(ri)加(jia)(jia)(jia)(jia)班(ban)(ban)(ban)(ban)(ban)。本案王(wang)某(mou)(mou)主张其(qi)属(shu)于(yu)工作(zuo)日(ri)延(yan)时(shi)(shi)(shi)加(jia)(jia)(jia)(jia)班(ban)(ban)(ban)(ban)(ban)。公(gong)(gong)司是(shi)(shi)否需要支付王(wang)某(mou)(mou)加(jia)(jia)(jia)(jia)班(ban)(ban)(ban)(ban)(ban)工资的(de)(de)关键在于(yu)王(wang)某(mou)(mou)的(de)(de)行(xing)为(wei)是(shi)(shi)否属(shu)于(yu)加(jia)(jia)(jia)(jia)班(ban)(ban)(ban)(ban)(ban)。根据(ju)(ju)《最(zui)高人(ren)民法(fa)(fa)(fa)院关于(yu)审理劳动(dong)争议案件(jian)适用(yong)法(fa)(fa)(fa)律若(ruo)干问题的(de)(de)解释(三)》第九条(tiao)规定(ding)(ding):“劳动(dong)者(zhe)主张加(jia)(jia)(jia)(jia)班(ban)(ban)(ban)(ban)(ban)费的(de)(de),应当就加(jia)(jia)(jia)(jia)班(ban)(ban)(ban)(ban)(ban)事实(shi)(shi)的(de)(de)存在承(cheng)担(dan)举证(zheng)责任(ren)。但劳动(dong)者(zhe)有证(zheng)据(ju)(ju)证(zheng)明(ming)(ming)用(yong)人(ren)单(dan)位掌(zhang)握加(jia)(jia)(jia)(jia)班(ban)(ban)(ban)(ban)(ban)事实(shi)(shi)存在的(de)(de)证(zheng)据(ju)(ju),用(yong)人(ren)单(dan)位不提供(gong)的(de)(de),由(you)用(yong)人(ren)单(dan)位承(cheng)担(dan)不利后(hou)果。”因(yin)此,劳动(dong)者(zhe)是(shi)(shi)否加(jia)(jia)(jia)(jia)班(ban)(ban)(ban)(ban)(ban)应当由(you)劳动(dong)者(zhe)进行(xing)举证(zheng)。本案中(zhong),王(wang)某(mou)(mou)提供(gong)了考勤记录证(zheng)明(ming)(ming)其(qi)每天在公(gong)(gong)司的(de)(de)时(shi)(shi)(shi)间(jian)超(chao)过8小时(shi)(shi)(shi),但并(bing)未提供(gong)证(zheng)据(ju)(ju)证(zheng)明(ming)(ming)其(qi)下(xia)(xia)班(ban)(ban)(ban)(ban)(ban)后(hou)留在办公(gong)(gong)室是(shi)(shi)在处(chu)理工作(zuo)事务的(de)(de)证(zheng)据(ju)(ju)。认定(ding)(ding)加(jia)(jia)(jia)(jia)班(ban)(ban)(ban)(ban)(ban)有两个要件(jian),分别是(shi)(shi)时(shi)(shi)(shi)间(jian)要件(jian)和工作(zuo)要件(jian)。劳动(dong)者(zhe)只有证(zheng)明(ming)(ming)其(qi)延(yan)长工作(zuo)时(shi)(shi)(shi)间(jian)是(shi)(shi)在处(chu)理工作(zuo)事务才(cai)能被(bei)认定(ding)(ding)为(wei)加(jia)(jia)(jia)(jia)班(ban)(ban)(ban)(ban)(ban)。

当然,如果用(yong)人(ren)单(dan)位(wei)规定(ding)了加(jia)(jia)班(ban)(ban)审批(pi)(pi)制(zhi)(zhi)度(du),只有(you)经审批(pi)(pi)的(de)延时(shi)工(gong)(gong)(gong)(gong)作(zuo)才(cai)属于加(jia)(jia)班(ban)(ban)。如今(jin),很多用(yong)人(ren)单(dan)位(wei)都不(bu)鼓励劳动者延时(shi)工(gong)(gong)(gong)(gong)作(zuo),希望劳动者能(neng)在(zai)法(fa)定(ding)的(de)工(gong)(gong)(gong)(gong)作(zuo)时(shi)间内完成工(gong)(gong)(gong)(gong)作(zuo),下班(ban)(ban)后得到更好的(de)休息(xi)。因此,设(she)立了加(jia)(jia)班(ban)(ban)审批(pi)(pi)制(zhi)(zhi)度(du)对(dui)加(jia)(jia)班(ban)(ban)总(zong)量进行控制(zhi)(zhi)。如果劳动者未经审批(pi)(pi)而自(zi)行延时(shi)工(gong)(gong)(gong)(gong)作(zuo),即使能(neng)够证明(ming)其(qi)延长工(gong)(gong)(gong)(gong)作(zuo)时(shi)间是(shi)在(zai)处理工(gong)(gong)(gong)(gong)作(zuo)事务也不(bu)能(neng)被认定(ding)为加(jia)(jia)班(ban)(ban)。但如果用(yong)人(ren)单(dan)位(wei)并未设(she)立加(jia)(jia)班(ban)(ban)审批(pi)(pi)制(zhi)(zhi)度(du)或者加(jia)(jia)班(ban)(ban)审批(pi)(pi)制(zhi)(zhi)度(du)形同虚(xu)设(she),那么只要劳动者可以证明(ming)其(qi)延长工(gong)(gong)(gong)(gong)作(zuo)时(shi)间是(shi)在(zai)处理工(gong)(gong)(gong)(gong)作(zuo)事务,那么就(jiu)很有(you)可能(neng)被认定(ding)为加(jia)(jia)班(ban)(ban),用(yong)人(ren)单(dan)位(wei)应当支付加(jia)(jia)班(ban)(ban)工(gong)(gong)(gong)(gong)资。
